A former SS commando who admitted killing three innocent Dutch civilians in 1944 has escaped justice after the case against him was dropped due to ill health. It would have been one of the last Nazi war crime trials held in Germany, but the case against pensioner Heinrich Boere will not now go ahead. He had been due to stand trial in Aachen, North Rhine-Westphalia, but an expert declared the 86-year-old, who lives in a nursing home, was too ill to stand trial. Boere suffers, amongst other ailments, from a heart illness. BILD.de called Boere on the phone: “There was no trial against you in Germany. What do you have to say to that?” Boere replied: “Leave me alone.” He then hung up. As a member of the ‘Silver Fir’ SS commandos, Boere shot three innocent civilians in Holland in 1944. He confessed to the murders when he was held captive as a prisoner of war in the Netherlands.

Heinrich Boere was due to be tried in Aachen early this year in what would have been one of Germany’s last Nazi war crimes trials. But the court in the western city said a medical examination had found his health was too poor for him to stand trial. “The defendant is not in a position to attend the trial as the accused due to a number of significant health problems,” the Aachen court said in a statement. Boere was captured by U.S. forces in the Netherlands after World War II and confessed to killing the Dutch civilians as a member of an SS hit squad targeting anti-Nazi fighters. He then escaped and fled to Germany, before being sentenced to death in absentia in the Netherlands in 1949. Germany refused a 1980 Dutch extradition request because of complications over Boere’s citizenship and other previous efforts to convict him in Germany had also failed. Der Prozess gegen einen mutmaßlichen SS-Mörder, der als Mitglied eines Killerkommandos drei Niederländer erschossen haben soll, kommt nicht zustande. Aus gesundheitlichen Gründen werde der 87-Jährige nicht vor Gericht gestellt, teilte das Landgericht Aachen am Mittwoch mit. Nach einem medizinischen Gutachten sei er nicht in der Lage, als Angeklagter einem Prozess beizuwohnen. Die Verhandlung gegen den in Eschweiler bei Aachen lebenden Mann wäre einer der letzten Kriegsverbrecherprozesse in Deutschland gewesen. Die nordrhein-westfälische Schwerpunkt-Staatsanwaltschaft für NS- Verbrechen hatte gegen den mutmaßlichen Dreifachmörder Anklage erhoben. Demnach soll ihn das SS-Mordkommando «Feldmeijer» rekrutiert haben, um niederländische Untergrundkämpfer zu ermorden. Er soll 1944 in Breda, Voorschoten und Wassenaar bei Den Haag «aus niedrigen Beweggründen und heimtückisch» drei Menschen getötet haben.
